ATI TEAS SMARTPREP TERMS OF USE

THE TERMS OF USE SET OUT BELOW ARE A LEGAL AGREEMENT (“AGREEMENT”) BETWEEN YOU AND ASSESSMENT TECHNOLOGIES INSTITUTE, LLC (“ATI), AND GOVERN YOUR USE OF THE ATI TEAS SMARTPREP MATERIALS AND RELATED ATI SERVICES, IN ALL FORMS AND HOWEVER PROVIDED TO YOU, WHETHER ONLINE OR DELIVERED IN HARDCOPY, INCLUDING ALL CONTENT, SOFTWARE, CODE, VIDEOS, DATA, GRAPHICS, TEST PREPARATORY MATERIALS, STUDY GUIDES, ASSESSMENTS AND ALL RELATED ATI TEAS SMARTPREP TOOLS AND RESOURCES (COLLECTIVELY, “ATI TEAS SMARTPREP”).

YOU MUST AGREE TO THESE TERMS BEFORE USING ATI TEAS SMARTPREP. TO AGREE TO THESE TERMS, CLICK “I AGREE.” IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CLICK “I AGREE.” IF YOU DO NOT CLICK “I AGREE”, YOU WILL NOT BE ABLE TO USE ATI TEAS SMARTPREP.

All of ATI’s User Terms and Conditions, which you accepted when you established an account with ATI, also govern and equally apply to your use of ATI TEAS SmartPrep. Such ATI User Terms and Conditions are incorporated into and made a part of these ATI TEAS SmartPrep Terms of Use.

ATI TEAS SmartPrep is an online, self-directed tool used by individuals for preparation and remediation for the ATI TEAS assessment. ATI TEAS SmartPrep content, which includes module pre and post test questions, lesson text, videos, images, and end of lesson quizzes, is proprietary and should not to be copied or shared.

ATI TEAS SmartPrep is the sole and exclusive property of ATI and protected by copyright. Each purchase of ATI TEAS SmartPrep entitles use by one person for their individual use only and is not transferrable or assignable to any other person or entity. You agree that you will not copy or share all or any part of ATI TEAS SmartPrep materials with anyone else. You also agree not to share with anyone else your password or access code that permits you access to ATI TEAS SmartPrep. Any copying or sharing of ATI TEAS SmartPrep, or passwords and access codes, is a violation of these terms and ATI’s intellectual property rights. ATI reserves the right to take legal action against anyone who violates this section. You represent that you are purchasing use of ATI TEAS SmartPrep to solely for purposes of preparing for the TEAS and not at the direction or for the benefit of any test preparation competitor.

Please note that use of ATI TEAS SmartPrep, as well as any other ATI product or service, does not guaranty outcomes or that users will necessarily achieve certain performance. You understand that your use of ATI TEAS SmartPrep does not guarantee your acceptance into any school or program.

If purchased through the ATI online store, ATI TEAS SmartPrep has a 90 day subscription access period, which begins upon your initial use of any of the four modules (reading, math, science, and English and language usage). Upon expiration after the 90 days, you acknowledge that the only information you will be able to access is your ATI TEAS SmartPrep results. An option to renew your subscription access will be presented to you for an additional fee. The 90 day subscription term will not apply to institution purchases of ATI TEAS SmartPrep, in which case the duration of your access will be determined by the institution that purchased your access to ATI TEAS SmartPrep.

These ATI TEAS SmartPrep Terms of Use will be available for your continued reference via a link in the ATI TEAS SmartPrep tool. ATI reserves the right to update these terms. Changes will be effective when posted, so please check these ATI TEAS SmartPrep Terms of Use periodically.
